Do you distribute products that are already packaged in Spain from an EU country or through imports from third countries?


In that case, it is possible that you are a product producer and, therefore, you must assume the obligations contained in Law 7/2022 and RD 1055/2022, on packaging and packaging waste.

Distributors must register as long as:

• Be the first distributor to introduce the packaging into the Spanish market.

• They use packaging for said distribution (boxes, pallets, shrink film, etc.), so they would become packagers and therefore product producers using these containers.

• In the event that the product producers have not designated an authorized representative in Spain, the first distributor or merchant of the packaged product based in Spain will be, alternatively, the subject responsible for the obligations established for the product producers.

Important note: The issuer of an invoice for packaged products must enter the RPP number on it, whether or not it is a producer of the product in question.


 

Who is a distributor?

Any natural or legal person in the supply chain that, regardless of the sales technique used, markets a product that is already packaged or packages or repackages it in its facilities.

The fact that a company is a distributor will not prevent it from being a Producer at the same time. It is a clear example when the origin of the containers marketed is importation, purchase in a country of the European Union or when the product is manufactured under a brand name. white exclusively for the distributing entity.



 

Obligations: Waste Collection

• The collection of packaging waste must be carried out using specific selective collection procedures. To this end, networks of selective collection points will be created distributed according to population density and in sufficient numbers, accessible and close to the owner or end user; In any case, delivery by the holder or end user will be at no cost to them.

• In the case of selective collection points located in distributors' establishments, the procedures referred to in the previous section will be organized in such a way that distributors will be obliged to accept the return of containers if they adopt and implement a Deposit System. and Return and Return (SDDR) after applying a fee that, if the waste is returned, will be returned to the consumer.

• In the case of industrial packaging, collections and transfers may be carried out by the producers themselves as they have been doing until now or they may request the services of SCRAP to coordinate the collections.

• When selling devices over the Internet, producers or distributors must guarantee that buyers can deliver their packaging in the same way as in physical stores.
